You could probably be charged in either state. Why Smith chose Florida is a mystery to me. It could be because he thought keeping the documents after being asked to turn them over was a more serious charge than taking them which, by itself, could have been passed off as an error. But the charges should have been the same in either court, so I don’t know.
Do they have to appeal and go through the long, drawn-out process, or can Smith refile in NJ or DC?
Smith could and should refile in DC. Like, today. I think the question of whether it is Constitutional for the DOJ to appoint special counsel needs to be decided, so that appeal needs to go forward, but it wouldn’t preclude Smith from refiling elsewhere.
Isn’t it odd that Trump’s lawyers didn’t raise the same objection against Smith’s appointment in the DC Jan. 6 case? Could it be because Trump doesn’t own that judge? Hmm.
