Unfairly it seems to put the burden on the "good" parent.

They are between a rock and a hard place. If they the kid away they are bad parents for keeping the kid away from the other parent..if they go along with custody and something happens while in the care of the other parent the good parent hear tsk tsk tsk you shouldn't have done that.
