In fact, that case (the bird one) is referred to in the fact sheet for this bill (SB 670 by Sen. Wiener). It's not explicitly called out, but the bill refers to unrelated outside parties bringing cases to block infill projects [that are wasteful and frivolous, although Sen. Wiener is more judicious than me]
