Here. They tried to hint at racism in the justice system then they use the victim of a crime to help her abuser and tormentor evade charges. The way the DA’s office went after Trina versus Edmd is glaring. So no getting her memories back isn’t a crime but the idea was that she would be able to stand trial once she remembers.
To your point, no, I do not think the Jury would be as sympathetic because she has her memories back and the first thing she did was commit a crime. But on this show? She’d probably get off. So it’s all for nothing anyway.
